Meeting permit conditions requiring mitigation can cost you time and money.  New rules require the applicant to:

  

 

1.      Submit a mitigation plan when requested  by the department. The department may incorporate all or part of the proposed mitigation plan as permit conditions.

 

2. Include in the mitigation plans: a-Statement of mitigation goals and  objectives,

including wetland types to be restored, created, or preserved.

 

b-Information regarding mitigation site location and ownership.

c-Site development plan

d-Description of baseline conditions at proposed site

e-Performance standards to evaluate the mitigation

f-A monitoring plan

g-A schedule for completion of mitigation

h-Provisions for management and long-term protection of site

 

3. “Assure” that upon completion that there will be no

net loss of wetland;

-Shall mitigate on site “where it is practical…and beneficial to

wetland resources”

-If [field staff] determines “practical…and beneficial” does not apply

shall mitigate in the watershed

-If the above are determined “infeasible and

impractical”

in the watershed DEQ shall require mitigation where

“feasible and practical”.

    

When possible, using a bank can substantially reduce cost and save time!

-Forget enforcement worries associated with meeting mitigation requirements;
